Conditions
of Sale
We
encourage you to call us with questions about our services or the items in our
auctions. Your satisfaction with both our merchandise and our auction house is
most important to us.
We try to
describe all auction lots completely, fairly, and conservatively, and we make a
concerted effort to include defects in our descriptions. The lots listed in each
auction will be offered by Kaye’s Auctions to the following terms and
conditions:
The property is sold
"as is" and neither the auctioneer nor any consignor makes any
warranties or representations of any kind or nature with respect to the
property, and in no event shall they be responsible for the correctness, nor
deemed to have made any representation or warranty of description, genuineness,
authorship, attribution, provenance, period, culture, source, origin, or
condition of the property, and no statement made at the sale, or in the bill of
sale or invoice, or elsewhere, shall be deemed such a warranty or
representation of an assumption of liability. All measures and weights are
approximate.
Kaye’s Auctions
reserves the right to reject any bid, as well as the right to refuse to
acknowledge any bidder. The highest bidder acknowledged by the auctioneer will
be the purchaser. In the event of a dispute between bidders, the auctioneer has
the final discretion to reoffer the lot in dispute. If any dispute arises after
the sale, Kaye’s Auctions' sale records shall be conclusive.
§ Terms of Sale
Cash
or checks are accepted with positive identification; out of province checks will
need a letter of credit. All purchases are subject to provincial sales tax, unless
the buyer has proof of exemption. Items must be paid for at the end of each
session.
